Losing a loved one is never easy. At Pollio Law Group, our extensive experience in Estate Administration makes your difficult emotional time easier. There are many, sometimes complex and complicated, aspects to administering an Estate. We guide the Executors through the Probate Process in order to ultimately distribute the assets in accordance with the Will provisions. This may include any or all of the following:
- Guiding Executors, Trustees, and Beneficiaries through the Estate Administration Process, including Probate (if required).
- Protecting Executors from liability and ensuring that an Executor fulfills his/her/their fiduciary duties to the Estate.
- Utilizing both the Federal and State Estate Tax codes to the fullest extent by identifying and realigning appropriate assets in order to maximize both Federal and State Tax Exemptions and by taking advantage of any appropriate disclaimers or elections, as appropriate.
- Effectuating transfer of Estate assets utilizing Receipts and Releases in accordance with the Will.
- Resolving disputes among Executors, Trustees, and Beneficiaries who are often siblings, with longstanding rivalries in a collaborative manner. If required, we will also coordinate with litigation counsel to help resolve issues efficiently and amicably.
- Guiding our clients through any audits to a favorable conclusion when an Estate Tax Return or a Gift Tax Return is audited.
- Coordinating with Estate Accountants in order to:
- Secure appraisals
